These Terms of Service govern your use of SiftFirst, operated by Jivaseva OU (registry code 12142627), Estonia. By creating an account or using the service, you agree to these terms. If you do not agree, do not use SiftFirst.
1. Who can use SiftFirst
SiftFirst is a tool for businesses and the people who hire for them. You must be at least 18 and able to enter into a contract, and you must use the service for legitimate hiring purposes on behalf of an organization you are authorized to represent.
2. What SiftFirst is, and what it is not
SiftFirst is a ranking and explanation assistant. It scores candidates against criteria you set and shows the evidence behind each score. It is not a hiring decision, not a background check, and not a determination of anyone's suitability or eligibility for employment.
A human stays in control: you set and edit the criteria, you review the evidence, and you make every hiring decision. You agree not to use SiftFirst to automatically reject candidates or as a substitute for human judgment.
3. Your responsibilities
- Use SiftFirst lawfully, including in line with employment, anti-discrimination, and data-protection laws that apply to you.
- Act as the controller of the candidate data you upload: have a lawful basis to process it, and inform candidates and honor their rights where required (for example, automated-employment-decision notice laws).
- Review results before acting on them, and make hiring decisions yourself rather than delegating them to the tool.
- Keep your account credentials secure and accept responsibility for activity under your account.
4. Acceptable use
You agree not to misuse SiftFirst, including: uploading data you have no right to share; attempting to break, overload, or reverse-engineer the service; using it to unlawfully discriminate; or reselling the service without our agreement.
5. Plans, fees, and cancellation
SiftFirst offers a free trial and paid plans (for example pay-as-you-go and monthly subscriptions). Prices and what each plan includes are shown on our pricing page. Paid features and billing are being rolled out; where billing applies, fees are charged through our payment processor, subscriptions renew until cancelled, and you can cancel at any time to stop future charges. Except where the law requires otherwise, fees already paid are non-refundable.
6. Intellectual property
We own SiftFirst, its software, and its branding. You own the inputs you provide (job descriptions, criteria, application materials). You grant us a limited license to process those inputs solely to provide the service to you. The screening results we generate for you are yours to use for your hiring.
7. AI outputs
Screening uses AI models, which can be wrong, incomplete, or biased. Scores, evidence, and summaries are aids to your judgment, not statements of fact about a person. Always verify before you rely on a result, and remember that the final decision, and responsibility for it, is yours.
8. Disclaimer of warranties
SiftFirst is provided 'as is' and 'as available', without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of results. We do not warrant that the service will be uninterrupted, error-free, or that outputs are correct.
9. Limitation of liability
To the fullest extent permitted by law, Jivaseva OU is not liable for indirect, incidental, or consequential damages, or for hiring decisions you make. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the 12 months before the claim.
10. Indemnification
You agree to indemnify Jivaseva OU against claims arising from your use of the service, your inputs, or your breach of these terms or of any law, including data-protection or anti-discrimination law.
11. Suspension and termination
You can stop using SiftFirst and delete your account at any time. We may suspend or end access if you breach these terms or use the service unlawfully. You can delete your account and all saved screenings yourself from your account settings.
12. Governing law and disputes
These terms are governed by the laws of Estonia. Disputes will be subject to the courts of Estonia, without affecting any mandatory consumer rights you may have where you live. We will always try to resolve issues with you directly first; contact us through the contact form at siftfirst.com/contact.
13. Changes to these terms
We may update these terms as the service changes. We will update the date above and, for material changes, give notice in the app or by email. Continuing to use SiftFirst after a change means you accept the updated terms.
